1. Scope & Acceptance

These Terms & Conditions govern all services, sessions, digital products, masterclasses, downloadable materials, website content, and related resources offered by The Charlie Hornes Coaching Studio, LLC, including clinical spiritual counseling, survival-instinct thought work, coaching-informed strategy sessions, in-person local services, and virtual care.

By booking, purchasing, accessing, submitting a form, enrolling in a plan, downloading materials, or participating in any service, product, or resource, you acknowledge that you have read and agree to these Terms.

2. No Provider-Client Relationship Until Accepted

Submitting a form, sending an email, purchasing a digital product, or requesting an appointment does not automatically create a provider-client relationship.

A provider-client relationship begins only when The Charlie Hornes Coaching Studio, LLC accepts the appointment or service arrangement and the client completes any required intake, agreement, payment, or scheduling steps.

3. Nature of Services

Services may include clinical spiritual counseling, spiritual care, meaning-making support, grief and trauma-informed spiritual care, survival-instinct thought work, nervous-system education, decision support, and coaching-informed strategy.

These services are designed to support adults navigating stress, grief, spiritual distress, decision strain, relational pressure, burnout-like patterns, and repeated survival responses under pressure.

Services may be offered in person in Hill Country Texas and virtually for clients outside the local area when appropriate.

4. Professional Role & Credentials

Dr. Charlie Michele Hornes, DMin, BCC, MCPC, is a Board Certified Clinical Spiritual Provider, ordained minister, doctoral-level spiritual care practitioner, and master certified thought-work strategist.

Clinical spiritual counseling is not the same as licensed mental health therapy, psychiatric care, medical treatment, legal advice, financial advice, or emergency crisis care.

No diagnosis, medical treatment, psychiatric treatment, or mental health therapy is provided through these services.

5. Adult Services Only

Services are intended for adults age eighteen (18) and older unless otherwise agreed in writing.

The Studio does not provide child therapy, family therapy, custody-related services, forensic evaluation, court-ordered counseling, or services intended to replace licensed medical or mental health treatment.

6. Emergency & Crisis Disclaimer

These services are not appropriate for emergency situations, psychiatric emergencies, active self-harm risk, danger to others, medical crisis, domestic violence crisis, abuse emergency, or situations requiring immediate intervention.

If you are in crisis, at risk of harming yourself or someone else, or need immediate support, call 911, go to the nearest emergency room, or contact a crisis hotline or licensed emergency provider in your area.

Email, scheduling forms, client portals, contact forms, text messages, and between-session support are not monitored as emergency services.

7. Payment Terms

Full payment is required at the time of purchase, booking, or enrollment unless a payment plan is explicitly offered at checkout.

Failure to complete payment obligations may result in suspension or termination of services, cancellation of appointments, or loss of access to materials without refund.

Clients and purchasers are responsible for ensuring payment information remains current. Failed payments may delay scheduling or access.

8. Initial Strategy Sessions & Private Appointments

The Initial Strategy Session is a paid consultation designed to explore the situation that brought the client to care and determine whether clinical spiritual counseling, thought work, or coaching-informed strategy would be an appropriate fit.

The session fee is $65 and may be applied toward a package purchased within seventy-two (72) hours of the session, when applicable.

Sessions require advance scheduling. Missed sessions, no-shows, or cancellations made less than 24 hours in advance are forfeited.

Clients arriving more than fifteen (15) minutes late may have the session shortened or rescheduled at the Studio’s discretion.

9. Clinical Spiritual Care Continuity Plans

Clinical Spiritual Care Continuity Plans are month-to-month service plans designed to reserve ongoing weekly clinical spiritual counseling across the year.

Continuity Plans include up to forty-six (46) weekly 50-minute sessions per year, billed in equal monthly payments. Some months may include fewer or more sessions depending on holidays, calendar structure, and planned provider time away.

Monthly billing remains the same because the annual continuity schedule is averaged across twelve (12) months. Planned provider time away is built into the annual session structure and pricing.

Acuity or other scheduling systems may display four (4) monthly appointment credits for scheduling purposes. This does not guarantee four sessions in every calendar month. The plan is structured around annual continuity, not a fixed four-session monthly package.

Continuity Plans may include up to two (2) 15-minute between-session support calls per month, scheduled at least twenty-four (24) hours in advance. These calls are for time-sensitive support related to ongoing work and are not emergency or crisis services.

Client cancellations, missed sessions, or no-shows do not roll over indefinitely and may be forfeited according to the cancellation policy. Provider-rescheduled sessions will be made up when possible within the continuity schedule.

Continuity Plans renew monthly until canceled in writing. Unless otherwise stated in writing, cancellation requires written notice before the next billing date. Partial-month refunds are not provided once the billing cycle has begun.

Application or approval may be required before enrollment. The Studio reserves the right to decline or discontinue a Continuity Plan if the client’s needs exceed the scope of services offered.

10. Virtual Care

Virtual sessions are offered for clients outside the local Hill Country Texas service area when appropriate for the nature of the work.

Clients are responsible for ensuring they have a private space, stable internet connection, and appropriate technology for virtual sessions.

Virtual care may not be appropriate for every situation. The Studio reserves the right to recommend referral to local, licensed, medical, mental health, pastoral, or crisis resources when a client’s needs exceed the scope of services offered.

11. Confidentiality & Privacy

Information shared during clinical spiritual counseling, thought work, and private sessions is treated with care, discretion, and respect for privacy.

However, these services are not legally protected psychotherapy, and confidentiality may be limited by applicable law, ethical duty, safety concerns, abuse reporting obligations, court order, or risk of harm to self or others.

Clients understand that email, website forms, scheduling tools, payment processors, video platforms, and digital platforms may carry privacy limitations. Sensitive information should not be sent through unsecured channels.

The Studio does not represent that all third-party platforms are HIPAA-compliant unless explicitly stated in writing.

12. Communication Boundaries

Email, text, portal messages, social media messages, and scheduling notes are not appropriate for emergencies, crisis care, or urgent clinical needs.

Between-session communication, when offered, is limited to scheduling, brief clarification, or support specifically included in the client’s service plan.

The Studio does not guarantee immediate response to messages outside scheduled sessions.

13. Client Responsibility

Clients remain responsible for their own decisions, actions, participation, and outcomes.

Services are intended to support reflection, clarity, spiritual care, thought work, nervous-system awareness, and decision-making. No specific outcome, result, emotional state, relationship outcome, spiritual outcome, professional outcome, or life change is guaranteed.

14. Digital Products, Courses & Masterclasses

All digital products, courses, masterclasses, downloadable resources, workbooks, image bundles, and printable materials are non-refundable once access has been granted or files have been delivered.

Access is licensed to the individual purchaser only. Sharing login credentials, forwarding purchased files, redistributing materials, uploading materials to public platforms, or reselling access is prohibited.

15. Intellectual Property

All content, frameworks, methods, worksheets, masterclasses, workbooks, digital downloads, visual assets, written materials, images, certificates, and instructional resources remain the intellectual property of The Charlie Hornes Coaching Studio, LLC unless otherwise stated in writing.

Materials are licensed for personal use only. Reproducing, distributing, publishing, teaching, selling, modifying for redistribution, or using these materials to train artificial intelligence systems without written permission is prohibited.

16. Personal Use License

Digital and printable materials may be downloaded, printed, and used by the original purchaser for personal, non-commercial use only.

Personal use does not include resale, redistribution, client use, group facilitation, professional training, commercial presentation, or inclusion in another product or program without written permission.

17. Artificial Intelligence, Image Generation & Creative Assets

Some visual assets, product images, or digital materials may be created with the assistance of artificial intelligence tools under the Studio’s creative direction.

All concepts, prompts, design direction, selection, editing, arrangement, naming, written materials, product structure, and final commercial use remain part of the Studio’s proprietary creative work unless otherwise stated.

Purchasers do not receive ownership of prompts, source files, editable design files, or production workflows unless explicitly granted in writing.

18. Recording, Screenshots & Session Materials

Clients may not record sessions, capture screenshots, distribute session materials, or share private session content without prior written permission.

The Studio may provide worksheets, notes, or resources during the course of care. These materials remain subject to the intellectual property and personal-use terms stated in these Terms.

19. Website Use

Users agree to access the website only for lawful purposes and not to attempt unauthorized access to systems, content, private pages, protected materials, checkout systems, or digital product delivery areas.

20. Refunds, Chargebacks & Disputes

Refunds are not guaranteed and are subject to the specific policy for the purchased service, appointment, plan, or product.

Digital products are non-refundable once delivered or accessed. Missed appointments, late cancellations, and no-shows may be forfeited.

Clients and purchasers agree to contact the Studio directly regarding billing concerns before initiating a payment dispute or chargeback.

21. Limitation of Liability

To the fullest extent permitted by law, the Studio’s total liability shall not exceed the amount paid by the client or purchaser for the applicable service or product.

The Studio shall not be liable for indirect, incidental, consequential, emotional, professional, financial, relational, spiritual, medical, or clinical damages arising from use of services, materials, or website content.

22. Indemnification

Clients and purchasers agree to indemnify and hold harmless The Charlie Hornes Coaching Studio, LLC, its owner, representatives, contractors, and affiliates from claims arising from participation in services, use or misuse of materials, violation of these Terms, or unauthorized redistribution of content.

23. Referrals & Scope Limits

The Studio may recommend referral to licensed mental health providers, physicians, clergy, legal professionals, financial professionals, crisis services, or other appropriate resources when a client’s needs exceed the scope of clinical spiritual counseling or coaching-informed strategy.

The Studio reserves the right to decline, pause, or discontinue services when the work requested is outside the scope of practice or not clinically, ethically, or practically appropriate.

24. Program & Service Modifications

The Studio reserves the right to modify schedules, service descriptions, digital products, course delivery methods, pricing, availability, or website content at any time.

25. Force Majeure

The Studio shall not be responsible for delays, cancellations, interruptions, or delivery issues caused by circumstances beyond its control, including technology failures, platform outages, natural disasters, illness, emergencies, power outages, internet disruption, acts of God, public emergencies, or other events outside reasonable control.

26. Governing Law

These Terms are governed by the laws of the State of Texas.

27. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in effect.

28. Agreement to Terms

By booking services, purchasing products, enrolling in courses, accessing digital materials, submitting forms, or using this website, you acknowledge that you have read, understood, and agree to these Terms.
